These Terms of Service ("Terms") govern your access to and use of Làm Nail POS (the "Service"), operated by Onyx Tech ("Onyx", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Làm Nail POS is a point-of-sale, scheduling, and checkout platform built for nail salons. It runs on the web (app.lamnailpos.com) and as an iOS application. The Service is sold to businesses ("Salons"), not consumers. You must be at least 18 years old and authorized to bind your Salon to these Terms.
2. Accounts
You are responsible for the credentials, PINs, and access controls of every staff member you add to your Salon. You agree to (a) keep credentials confidential, (b) immediately notify us at [email protected] of any unauthorized access, and (c) accept responsibility for all activity under your account.
3. Fees and Payments
Fees are listed at lamnailpos.com/pricing. Subscription fees, where applicable, are billed in advance via Stripe and are non-refundable except as required by law. Per-transaction fees are charged on each sale processed through the Service in addition to standard Stripe processing fees. Pricing may change with at least 30 days' notice; continued use after the effective date constitutes acceptance.
Payment processing is performed by Stripe, Inc. under its own terms. You authorize us to share necessary information with Stripe to enable payments to your Salon.
4. Acceptable Use
You agree not to: (a) use the Service for any illegal purpose; (b) reverse-engineer, scrape, or attempt to extract source code; (c) use the Service to send unsolicited communications; (d) attempt to disrupt or overload the Service; (e) impersonate another person or misrepresent your affiliation with any entity; or (f) violate the rights of any third party, including your customers.
5. Your Data
You own the data you enter into the Service (customer records, services, sales, staff). We process that data on your behalf to deliver the Service. See our Privacy Policy for details. You are responsible for obtaining any consents required from your customers and staff under applicable law (including SMS, marketing, and biometric consent where relevant).
6. Intellectual Property
The Service, including its software, design, and trademarks ("Làm Nail POS", "Onyx", the Onyx mark) are owned by Onyx Tech. We grant you a limited, non-exclusive, non-transferable license to use the Service for your Salon's internal business operations during the term of your account.
7. Suspension and Termination
You may cancel your account at any time by contacting [email protected]. We may suspend or terminate your account if you (a) materially breach these Terms, (b) fail to pay fees when due, or (c) use the Service in a way that creates legal or security risk for us or other users. We will provide reasonable notice except where doing so would create further risk.
On termination, you may export your data for 30 days; after that, we may delete it subject to backup retention windows described in the Privacy Policy.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONYX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONYX'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (b) ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT WILL ONYX BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA.
10. Indemnification
You will defend, indemnify, and hold harmless Onyx and its officers, employees, and agents from any third-party claim arising out of (a) your use of the Service, (b) your data or content, or (c) your violation of these Terms or applicable law, including any claim by your customers or staff.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.
12. Changes
We may update these Terms from time to time. Material changes will be announced via the Service or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
